General Terms and Conditions of Capla Hockey Academy

  1. Confirmation of Participation / Event Cancellation
    1. A claim to participate in a course only exists if the course fees have been paid in a timely manner and the registration has been confirmed in writing by the Academy. Participation is binding upon receipt of the course fees in the Capla Hockey Academy's account.
    2. Unless agreed otherwise, children and youth who have completed their 6th year through the completion of their 16th year can participate in events from Capla Hockey Academy.
    3. The minimum number of participants per event is 20. If this minimum number of participants is not reached for an event up to three weeks before the event commences, Capla Hockey Academy shall determine whether this event takes place.
    4. In the event of force majeure conditions or in the event the required minimum number of participants is not reached, Capla Hockey Academy has the right to cancel the event. If this happens, Capla shall refund the participation fee within 14 days. If the required minimum number of participants is not reached, a possible cancellation of the event may take place at the latest 14 days before the intended beginning.

  2. Travel to and from events
    Participants are themselves responsible for the travel to and from events. The participants are expected to be present promptly at the beginning of the course - at least 30 minutes beforehand.

  3. Equipment
    The following equipment should be brought:
    • Complete equipment according to the requirements of the IIHF Youth Game Regulations (Nachwuchsspielordnung)
    • Insurance cards or address and member numbers of the insurance company
    • Practice clothes, for bad weather as well, toiletries, towels, bathing trunks and bathing sandals
    • Underwear for two training sessions, one ice training and one dry training, training outfit, athletic shoes for inside and outside (light sole)
    • Jump rope, something to write with, notebook, water bottle and / or plastic cup
  4. Health Insurance, Liability Insurance, Accident Insurance
    1. The participants are not insured for health, liability or accidents, neither during events nor when Capla Hockey Academy drives to or back therefrom.
    2. The participants must be insured for health and liability - if necessary through their legal guardians. Taking out accident insurance is recommended.
    3. By registering, the legal guardian(s) confirm that there is no objection to participation in the events from a bodily or medical viewpoint. If the participant is not capable of performing certain exercises for medical reasons, this must absolutely be reported.
    4. Participants must carry adequate health insurance and they must have international health insurance. Participation in courses with Capla Hockey Academy is at your own risk.

  5. Cancellation, Illness and Injury
    1. Participants can cancel the contract at any time. Cancellation must be in writing.
    2. Upon cancellation, the participant loses the right to participate in the events that have been booked.
    3. If the cancellation takes place up to 8 weeks before the commencement of the course, 50% of the costs already paid will be refunded,
      if cancellation takes place up to 2 weeks before the commencement of the course, 20% of the costs already paid will be refunded
      If cancellation takes place within 2 weeks before the commencement of the course, 5% of the costs already paid will be refunded
    4. If the registered participant does not come, it is possible for a substitute of the same age and position to participate, after the written approval of Capla Hockey Academy.
    5. The fee will not be refunded if a participant does not show up without a prior statement of cancellation.
    6. If the cancellation is due to illness or injury of the participant, then the refund increases by 10% of the costs already paid, as long as this is attested by a physician's note.

  6. Liability Limits
    1. Any and all liability for slight negligence is excluded, unless damages arising out of injury to life, body, health or damage to warranties are involved or claims that are based on the German Product Liability law (Produkthaftungsgesetz). Furthermore, liability for neglect of duties, which only when fulfilled then enables execution of the contract and to which adherence the contractual partner may regularly trust, remains unaffected. The same holds for neglect of duties by agents appointed by our constitution documents, especially agents and our assistants.
    2. A claim to compensation for damages for violation of substantial contractual obligations is limited to foreseeable damage that is typical to this type of contract, unless gross negligence is present.
    3. It is expressly pointed out that participation shall take place at your own risk and injuries and accidents can not be excluded when practicing the sport, even when a large amount of care is used. Capla Hockey Academy expects that participants are sufficiently prepared physically and psychologically. Capla Hockey Academy assumes absolutely no liability for loss and / or damage to money, valuables and any other items brought with participants. Participants must carry adequate health insurance and they must have international health insurance. Participation in courses with Capla Hockey Academy takes place at your own risk.

  7. Privacy and Data Security
    1. All personal data provided by legal guardians will be collected, processed and used by Capla Hockey Academy by automatic procedures in compliance with the data security applicable under the contract, to the extent necessary, to establish, organize and modify the contractual relationship. Capla Hockey Academy is authorized to provide the data to third parties hired by Capla to execute the contract, especially to affiliates.
    2. Transfer or use of personal data for other purposes is also permissible, if it is necessary to preserve authorized interests (e.g. delivery of goods ordered to the most recent customer address) and that there is no basis for the assumption that the affected party has a privacy interest in preventing transmission or use of the personal data. At any time can legal guardians object to the transfer and use of personal data for this purpose via the contact details specified below and without information about the reasons.
    3. Basic personal data, if recorded: occupation, sector or business relationships, name, title, academic level, address and year of birth may also be saved, processed and used by Capla Hockey Academy for marketing research purposes, written consulting and information purposes (advertisements) for products and services to the degree necessary. At any time can legal guardians object to the transfer and use of personal data for this purpose via the contact details specified below and without information about the reasons.
    4. Additionally, telephone numbers, cell numbers, fax numbers and email addresses may be saved, processed and used by Capla Hockey Academy and their affiliates for consulting and information purposes about their products and services (advertisements & market research) via telephone and electronic means of communication (including text services / email services). At any time can legal guardians withdraw their approval via the contact details specified below without information about the reasons.

  8. Right to one's own picture / Spoken word
    The participants and their legal guardians irrevocably consent to the production, distribution and public display of portraits and the recording, distribution and public accessibility of the participant's spoken word for photographs, live transmission, broadcasts as well as video recordings and/or audio recordings that are produced by Capla Hockey Academy and from third parties hired by them as a part of the event. Consent applies for all present and future media, especially for the homepage of Capla Hockey Academy. Participants and their legal guardians shall refrain from asserting claims due to the aforementioned utilization of participant's portraits and spoken word.

  9. Exclusion
    Capla Hockey Academy reserves the right to exclude participants from the event with immediate effect for due cause, which is present in the person or in the conduct of the participant (especially rioting, acts of violence, vandalism, racism, drug and alcohol abuse, criminal behavior, for any crass violations against event rules or for any improper or unsportsmanlike conduct). The participation fees shall not be refunded in this situation.

  10. Severability Clause
    If certain aspects of these terms and conditions are or become invalid, unenforceable or can not be implemented, in whole or in part, the validity of the contract and the other conditions is not affected by this.
